Please read these Terms of Service ("Terms") carefully before using www.prishious.shop (the "Site") operated by Prishious ("we," "us," or "our"). By accessing or using our Site, placing an order, or engaging with any part of our services, you agree to be bound by these Terms. If you do not agree, do not use this Site.
1. General Conditions
- We reserve the right to refuse service to anyone for any reason at any time.
- You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our express written permission.
- You must be at least 18 years of age or have parental/guardian consent.
- We reserve the right to modify or discontinue the Site at any time without prior notice or liability.
2. Accuracy of Information
We make reasonable efforts to display our products accurately. However:
- We do NOT guarantee that your device's display of any colour, texture, size, or detail will be accurate.
- Product photographs are illustrative only and may vary from actual products due to lighting, photography, and screen settings.
- Minor variations in colour, shade, finish, texture, weight, and dimensions are inherent characteristics of jewellery and are NOT defects. Such variations shall not constitute grounds for a refund, return, or exchange.
3. Products and Pricing
- All prices are in Indian Rupees (INR), inclusive of applicable taxes unless stated otherwise.
- We reserve the right to modify prices at any time without notice.
- We do not guarantee perpetual availability of any product.
- In case of a pricing error, we may cancel the order and issue a refund as our sole obligation.
4. Order Acceptance and Cancellation
- Placing an order constitutes an offer to purchase, not a confirmed sale.
- We may accept or reject any order at our sole discretion.
- An order is confirmed only upon successful payment via Razorpay and receipt of confirmation email.
- We may cancel orders if we suspect fraud or Terms violation.
- Customer cancellations are permitted only before dispatch. Once shipped, orders cannot be cancelled.
5. Payment Terms
⚠️ ALL PAYMENTS ARE PREPAID ONLY. We do NOT offer Cash on Delivery (COD).
- Payments are processed securely through Razorpay Solutions Pvt. Ltd., an RBI-authorized Payment Aggregator.
- Accepted methods: UPI (Google Pay, PhonePe, Paytm, BHIM), Debit Cards (Visa, Mastercard, RuPay, Maestro), Credit Cards (Visa, Mastercard, RuPay, Amex, Diners Club), Net Banking, Mobile Wallets, and select EMI options.
- We do NOT store any card details, CVV, UPI PIN, or banking credentials.
- Prishious is NOT liable for payment failures, transaction errors, or unauthorized transactions caused by Razorpay, your bank, or any third party.
6. Intellectual Property
All Site content — including text, graphics, logos, images, product designs, and software — is the exclusive property of Prishious and protected under Indian copyright and trademark laws. Unauthorized use may result in legal action.
7. User Conduct
By using our Site, you agree NOT to:
- Use the Site for any unlawful or fraudulent purpose
- Attempt unauthorized access to any part of the Site
- Transmit viruses, malware, or harmful code
- Impersonate any person or entity
- Submit false, misleading, or fraudulent information
- Use bots, scrapers, or automated tools to access the Site
8. Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- Prishious, its proprietor (Sachin Tripathi), owners, employees, agents, and affiliates ("Prishious Parties") shall NOT be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, revenue, data, goodwill, personal injury, emotional distress, or any intangible losses — arising from use of the Site or products.
- Our maximum aggregate liability for all claims shall not exceed the actual purchase price of the specific product giving rise to the claim.
- Prishious Parties are NOT liable for:
- Force majeure events: natural disasters, pandemics, government orders, internet outages, courier delays, payment gateway downtime
- Third-party failures: acts or omissions of Razorpay, Shiprocket, courier partners, or Shopify
- Health issues: allergic reactions, skin irritation, rashes, discolouration, or any health issues from product use — customers must verify materials and consult a dermatologist if they have sensitivities
- Device/data issues: damage to your device or data loss from accessing the Site
9. Assumption of Risk
By purchasing from Prishious, you acknowledge and assume all risks associated with jewellery use, including allergic reactions, skin sensitivities, breakage, and tarnishing. Prishious bears no responsibility for such occurrences.
10. Indemnification
You agree to fully indemnify, defend, and hold harmless all Prishious Parties from any claims, damages, losses, costs, and legal fees arising from:
- Your use of the Site or products
- Your violation of these Terms or any law
- Your violation of third-party rights
- Any fraudulent activity on your account
This obligation survives termination of these Terms.
11. Disclaimer of Warranties
All products and services are provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
12. Third-Party Links
We are not responsible for the content, privacy policies, or practices of any third-party sites. Your interaction with third parties is at your own risk.
13. Governing Law and Jurisdiction
These Terms are governed by Indian law. All disputes are subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra, India.
14. Dispute Resolution
Parties agree to attempt good-faith negotiation for 30 days. Unresolved disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator in Mumbai. The arbitrator's award is final and binding.
15. Severability
If any provision is found invalid, the remaining provisions continue in full force.
16. Entire Agreement
These Terms, with our Privacy Policy, Return and Refund Policy, and Shipping Policy, constitute the entire agreement.
